It is not uncommon for tenant occupied properties to be offered for sale. However, tenancies can have a big impact on possession dates for the buyer. For month to month tenancies, a notice period to vacate is 60 days from the start of the next rental period. All the subjects must be off of the sale before the notice is given and the tenant is entitled to an additional payment of 1 month’s rent. For a lease, there is no notice period – the tenant has a right to uninterrupted occupation of the premises until the end of the lease.
